Clery Act Compliance
Your safety on campus is an utmost concern when choosing the right college to attend or work at. To address this concern, the Jeanne Clery Campus Safety Act (Clery Act) is a federal law enacted requiring universities receiving federal funding to be transparent about campus crime.
Our primary responsibility is to ensure the university's full adherence to the federal Jeanne Clery Campus Safety Act (Clery Act).

Individuals defined as Campus Security Authorities (CSAs) by the Clery Act cover:
- individuals with campus security responsibilities
- individuals designated by the campus
- officials with significant responsibility for student and campus activities
- the campus police department
CSAs are required to report criminal incidents to the University Police Department contemporaneous with occurrence to ensure inclusion and avoid duplication of statistics in the annual Security and Fire Safety Report (ASFSR).
In the context of the Clery Act, certain positions are exempt from being designated as CSAs and are not obligated to report crimes under this act.
- A faculty member who does not have any responsibility for students and campus activity beyond the classroom
- Clerical or cafeteria staff
- Facilities or maintenance staff
- Any support position that does not have significant responsibility for students and campus activities
- Professional and pastoral counselors are specifically exempt when they are functioning within the scope of their license or certification and providing counseling to members of the institution's community
- Medical physicians and nurses are exempt unless they have specific responsibilities beyond providing medical care to individual students
Even when an individual is exempt, they are still encouraged to inform victims of their options for reporting crimes.
In compliance with the Clery Act, UTRGV publishes an annual Security and Fire Safety Report (ASFSR) to provide transparency about safety on and around campuses.
The offenses covered include
- criminal offenses
- hate crimes
- VAWA (Violence Against Women Act) offense
- arrests/referrals for certain liquor, drug, weapons law violations
- hazing
